Acceptable Internet User’s Policy

 

SCSI provides connection to the World Wide Web to its subscribers for their personal and/or commercial use.  All SCSI Subscribers must agree to abide by SCSI’s Acceptable Internet User’s Policy (AIUP) for any network(s), which they may traverse and comply with all local, state and federal laws.

 

The SCSI network must be used lawfully.  All material transmitted, distributed, or stored on the network must conform to all applicable laws and regulations.  Material protected by copyright, trademark, or other intellectual property rights may not be modified without express permission of the owner.  Any material that is obscene, malignant, poses an illegal threat, violates export control laws, or violates generally accepted standards of Internet conduct and usage is prohibited.  Falsification of user information provided to SCSI or to other users of the service in connection with use of a SCSI service is also prohibited.   In addition, SCSI subscribers agree to the following terms and conditions:

Subscriber acknowledges and agrees that SCSI has no control over the content of any information contained on its network and/or the World Wide Web.  SCSI makes no warranties of any kind, whether expressed or implied, as to the availability, content of the information, products, or other services provided on its network.  SCSI also disclaims any warranty of MERCHANTABILITY or fitness of any particular purpose.  SCSI shall not be responsible for damages that are incurred or suffered by Subscriber as a result of use of its network.  This includes; but is not limited to, loss of data resulting from delays, misdeliveries, non-deliveries, or service interruptions caused by SCSI or other omissions or errors caused by any other entity(s) supplying said network.  Use of any information obtained via the network provided by SCSI is at the Subscriber’s sole risk and the Subscriber acknowledges that he/she is aware that downloading any data from the network may contain computer viruses and specifically releases SCSI from any and all liability for same. 

 

Services provided by SCSI through its network may change at any time without notice.  SCSI reserves the right to change any service(s) offered or the features of any service(s) offered, at anytime, including changes to access and use procedures (i.e., such as an idle disconnect and the system’s hardware and software).

 

Subscriber specifically acknowledges and agrees that SCSI’s network and services shall only be used for lawful purposes consistent with the rights of all other parties which comprise said network.  Transmission by the Subscriber of any material in violation of any US, State or International law or regulation is strictly prohibited.  This restriction(s) includes, but is not limited to, the transmission of copyrighted material, trademarks, material protected by trade secrets, the invasion of any right and/or privacy of any person or entity and the transmitting and/or storing of any material that is obscene, libelous or defamatory.  The Subscriber specifically agrees to indemnify and hold SCSI and any entity(s), which comprise its network, harmless from any such claims, which cause damage to any other party.

 

Subscriber agrees, when accessing any network, to comply with all requirements of the other network’s user policies.

 

Resale of any of SCSI’s services is strictly forbidden.

 

To enhance availability to all Subscribers, Subscriber agrees to log off if idle for more than ten (10) minutes, and not to use any artificial means to keep sockets connected beyond the time off period.  Also Subscriber acknowledges and agrees that he/she is entitled to log in one dial-up modem to TCP/IP connection.  The use of auto-redial to maintain connection is prohibited.


 

 

The Internet service has been engineered and designed with one (1) modem for each of five (5) users on the system.  Industry standard is one (1) modem for every twenty (20) users for the large system providers and twelve (12) to fifteen (15) to one (1) for small internet providers.  SCSI is offering a system, which has been designed and engineered to exceed all prevailing Internet industry standards and offerings, which will allow a minimum of 20 simultaneous sessions for each 100 users.  SCSI sternly prohibits the posting of substantially similar messages commonly known as “SPAM”.

 

Subscriber agrees that commercial posting to non-commercial news groups or postings which are directed to either inappropriate, unrelated or groups comprised of more than twenty (20) entities is prohibited.  Bulk mail through SCSI’s system to more than 100 users is not permitted.  Subscribers sending e-mail with more than five recipients must run consecutive mail delivery programs.  Concurrent mailing to more than five recipients and unsolicited mailing to multiple recipients is strictly prohibited.  As a courtesy, SCSI may offer software, which is “shareware”.  SCSI is not the author or otherwise responsible for any of this “shareware”.  Therefore, SCSI makes NO WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, WITH RESPECT TO SUCH SHAREWARE OR ANY DAMAGES RESULTING FROM USE THEREOF.  SUBSCRIBER ASSUM ALL RISK WITH RESPECT TO SUCH SHAREWARE AND AGREE THAT HE/SHE WILL NOT ASSERT ANY CLAIM AGAINST SCSI OR OTHER ENTITIES WHICH COMPRISE SCSI’S NETWORK WITH RESPECT TO ANY SHAREWARE.

 

The Electronic Communication Privacy Act (ECPA) requires that SCSI notify you that e-mail is not secure and is subject to interception.  As a Subscriber, you must assume that any e-mail or other communications on SCSI’s network may be seen by others.

 

USE OF SCSI’S NETWORK AND SERVICES AND THE INTERNET IS AT SUBSCRIBER’S SOLE RISK.  SCSI DOES NOT WARRANT THAT ITS SERVICES AND SYSTEMS WILL BE UNINTERRUPTED OR ERROR FREE, NOR DOES SCSI MAKE ANY WARRANTY AS TO THE RESULTS OF THE INFORMATION OBTAINED FROM THE USE OF ITS SERVICE, SYSTEM OR THE INTERNET.

 

The Internet service is provided for data communication and associated functions only.  Services which provide voice communications over the Internet system, are strictly forbidden.  SCSI reserves the right to block access to voice network services through the Internet service offering.

 

If at any time, SCSI determines that a Subscriber has violated the provisions of this Agreement, or has failed to pay service charges as scheduled, Subscriber agrees that his/her service may be terminated with or without notice.

 

The system for the Naval Base at Guantanamo Bay, has been engineered, designed, installed and priced to serve a minimum base of 600 users.  SCSI and the Navy will review the offering every six months to monitor the size of user base and if the base drops below 600, SCSI reserves the right to negotiate the monthly price accordingly.

 

Subscriber agrees that this AIUP may be revised updated and/or modified as required by the Internet and/or ISP policies.  Subscribers will be given thirty (30) days written notice of any proposed revision, updates and/or modifications.  If Subscriber does not object in writing within thirty (30) days of such notification, it will be presumed that Subscriber agrees to said changes.  Continued use of SCSI’s Internet Access facilities after thirty days notice constitutes Subscribers agreement with the revised AIUP.
